SUMMARY

Kenneth R. Stone is an experienced problem solver specializing in complex business, construction and real estate disputes. Representing plaintiffs and defendants in a broad and challenging litigation practice for 35 years, Mr. Stone has extensive experience and success inside and outside the courtroom in resolving all aspects of real estate and business matters for clients ranging from individuals and partnerships to small, mid-sized and nationally-recognized corporations.

Mr. Stone has successfully represented property owners, developers and builders in real estate disputes, including sale and purchase agreements, construction, easements, ownership and financing issues. Other clients have included business owners, partners and corporate shareholders in resolving an array of challenging business-related issues, such as contractual disputes, collection or enforcement of financial obligations, trade secrets, licensing matters and employment disputes, among others.

Mr. Stone is a graduate of University of California, Berkeley (B.A., cum laude, 1972), and University of California, Davis School of Law (J.D., 1975). He has served as a Pro Tem Settlement Judge, as a court-appointed arbitrator and as a mediator (both privately and under the auspices of the American Arbitration Association) for several years. He has successfully assisted many attorneys and their clients in resolving a wide array of real estate and business disputes.

CASES

Represented developer of master-planned community in vigorously litigated dispute with national homebuilder regarding contractual rights within the community, resulting in multi-million dollar judgment and successful defense of homebuilder’s claims in excess of $10 million.

Represented winery-related family business in complex quiet title lawsuit involving multiple property owners and difficult easement issues, resulting in comprehensive settlement protecting client’s future subdivision rights.

Represented former NBA star player in successfully resolving several real estate and business related disputes, including athletic-product marketing and distribution agreements, real property purchases and business entity lease litigation.

Represented co-owner of 2,000 acres of developable land in Chico area in litigation surrounding ownership and development rights, resulting in partition of the property and recovery of costs and expenses of nearly two million dollars.

Represented business consultant and software developer in lawsuit with former partner over ownership rights, misappropriation of trade secrets, and extensive monetary damages, leading to favorable settlement payment to client and avoidance of multi-million dollar cross-claims.

Represented owner of high-end hotel in connection with resolving significant defects and design deficiencies in construction process, as well as arbitration with equipment and product vendors resulting in substantial recovery for client.

The representation of many small to medium-size business owners in cost-effective resolutions of a wide variety of disputes with vendors, customers and/or employee-related matters.
